Outside the U.S. citizens own LLC in Delaware?
I own a few companies online that offers web development and optimization other search services and sell software products online. Most of my clients are U.S. citizens and, because I am, I decided to register LLC U.S.. I spent some time reading various information about forming an LLC in Delaware for a non-US citizens living outside the U.S., but I have some questions still mostly about paying taxes. I spoke with a registered agent and was told that registration LLC can do for me but advised me to speak to someone about filing and paying taxes in my case – and the U.S. citizens do not, which has LLC in Delaware and serving U.S. customers highly. Any help on the type of tax you will pay will be appreciated. Thank you all.
By default, a domestic LLC (a Delaware LLC) is considered fiscally transparent United States federal income tax. This is not true in all states, although most follow the federal treatment. For purposes of federal income taxes, therefore, if you own 100% interest in the LLC, will fully account, and you will be taxed (or taxed) as if there LLC. If more than one owner the LLC is treated as a partnership. However, it still must have federal income tax liability unless a business is conducted in the United States. If services are actually performed outside the United States should not be regarded as conduct of business within the United States, although its customers are here. As noted above, the State tax treatment may vary, so it may be a good idea to consult a tax professional in every State in you have a customer. Of course, the above advice is general and should not be relied upon, but must be confirmed with a qualified adviser. Based on my experience, You may also need the help of a tax advisor to convince their customers that they need to withhold U.S. tax payments they make to you.
